Construction

We have a very solid construction team. 20 lawyers, 7 of whom are partners, being linked to the team. Our lawyers work with both offshore and land-based construction. Most of our cases are for owners, and we represent a number of the country’s largest government owners. We also have a large number of cases from medium-sized and small contractors and provide assistance to architects and technical advisors as well.

Our lawyers work with all types of contracts and contract issues related to construction, including:

  • Drafting of contracts
  • Quality assurance of draft contracts
  • Contract negotiations
  • Contract follow-up
  • Contract disputes, settlement negotiations, brokering and litigation
  • Providing internal and external contract law courses

We have special litigation expertise. In our opinion, this expertise is very important to our ability to advise clients. This applies not only in the dispute phase, but also in earlier phases, where the aim is to avoid conflict. Our litigation expertise makes us well qualified to assess the risk of legal proceedings, negotiate good solutions, and last, but not least, bring cases to trial before any courts.

The scope of many of our cases requires good teamwork to find good solutions. We have substantial experience with such team work, and always attach importance to establishing good cooperation with our clients.

The firm has played a key role in the development of law with respect to standard contracts, nationally and internationally, for many decades, through, for example:

  • Participation and formulation of a number of building and construction standards, such as NS 3430, NS 8401, NS 8402, NS 8405 and NS 8406.
  • Participation in international negotiations on the revision of standard contracts in the International Federation of Consulting Engineers (FIDIC)

We also regularly publish articles and literature in this field, including the Commentary of the standard contract for performance contracts NS 8405.
